By accessing and using the MindX Africa website and services, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

These terms apply to all users, including visitors, clients, corporate partners, and anyone who accesses or uses our services in Ghana.

MindX Africa provides professional mental health services including:

• Individual therapy and counseling sessions
• Couples and family therapy
• Employee Assistance Programs (EAP) for organizations
• Corporate wellness programs
• Mental health workshops and training
• Online and in-person therapy sessions

Services are provided by licensed mental health professionals in Ghana. We reserve the right to modify, suspend, or discontinue any service at any time.

You agree to:

• Provide accurate, current, and complete information when using our services
• Maintain the security of your account credentials (if applicable)
• Use our services only for lawful purposes and in accordance with these terms
• Not share false, misleading, or fraudulent information
• Respect the confidentiality and privacy of other clients
• Attend scheduled appointments or provide adequate notice for cancellations
• Comply with all applicable laws and regulations in Ghana

All content on our website, including text, graphics, logos, images, and software, is the property of MindX Africa or its licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit viruses, malware, or any harmful code through our platform
• Harass, abuse, or harm other users, therapists, or staff
• Impersonate any person or entity or misrepresent your identity
• Collect or store personal data about other users without permission
• Use automated systems (bots, scrapers) to access our services

For Employee Assistance Program (EAP) and corporate services:

• Services are provided under separate corporate agreements
• Employee eligibility is verified through corporate partner systems
• Usage data may be shared with corporate partners in aggregated, anonymized form
• Individual therapy sessions remain confidential per professional standards
• Corporate clients are responsible for payment as per their service agreement

To the maximum extent permitted by law, MindX Africa shall not be liable for:

• Indirect, incidental, or consequential damages arising from use of our services
• Loss of data, profits, or business opportunities
• Service interruptions or technical failures beyond our control
• Actions or decisions made based on information provided through our services

Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim.

You agree to indemnify and hold harmless MindX Africa, its employees, therapists, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of our services
• Your violation of these Terms of Use
• Your violation of any rights of another party
• Any content you submit or transmit through our platform

We reserve the right to terminate or suspend your access to our services at any time, without prior notice, for:

• Violation of these Terms of Use
• Fraudulent or illegal activity
• Non-payment of fees
• Any other reason we deem necessary to protect our services

Upon termination, your right to use our services will immediately cease, and we may delete your account and data subject to legal retention requirements.

These Terms of Use are governed by and construed in accordance with the laws of Ghana. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Ghana.

We reserve the right to modify these Terms of Use at any time. We will notify users of significant changes by posting the updated terms on this page and updating the "Last updated" date.

Your continued use of our services after changes constitutes acceptance of the updated terms. If you do not agree to the changes, you should discontinue use of our services.
